小实体标准（满足以下任何一个条件都可以，小实体大部分官费减免60%）
Standard of small entity (Most of the official fees of small entity will be reduced by 60% by meeting any one of the following criteria.)
1）个体自然人; A person;
2）小型企业（员工人数不超过 500 人，含有控制或被控制关系的关联方人数）；A small business having no more than 500 employees (includingemployees of affiliates with controlling or controlledrelationship);
3）非盈利组织（例如：大学）；Non-profit organizations (e.g. universities);
备注：发明人/申请人目前没有或根据合同或法律没有义务将发明转让、授予、让与或许可任何 非小实体的第三方，即实际权利人不能是非小实体的第三方。(Note: The inventor / applicant has not assigned, granted, conveyed, or licensed, andis under noobligation undercontractorlawtoassign, grant, convey, or license, any rights in theinventiontoanythird partythatis notasmallentity,meaning the actual patent owner cannot be a non-small entitythird party.)
P.S. 如果申请人是母公司控股的子公司/关联公司，母公司不符合小实体的话，那也无法按照小 实体申请。If the applicant is a subsidiary or affiliated company controlled by the parent company, and the parent company does not conform to small-entity standards, it cannot apply for a patent as a small entity.
Warning：37 CFR1.27(h) indicates that any attempt to fraudulentlyestablishstatusasasmallentityorpay fees as a small entity will beconsideredasafraudpracticedorattemptedontheOffice.USPTO
may institute a review of pending patent applications or patents to determine whether there is a false entity status claim.
警告：根据《美国联邦法规》第 37 编第 1.27(h)条规定，任何通过欺诈手段试图确立小实体资格 或按小实体标准缴纳官费的行为，均将被视为向专利商标局实施或意图实施的欺诈行为。美国专 利商标局可对申请中或已授权的专利启动审查程序，以判定是否存在虚假实体状态声明。
